Architects Now Protected When Acting as Good Samaritans

Senate File 2255 protects registered architects under the Iowa Tort Claims Act

Des Moines, IA (April 1, 2014) –On Wednesday, March 26, Governor Branstad signed Senate File 2255 into law. This legislation, to take effect July 1, will allow architects to aid the citizens of Iowa in post disaster situations as members of a Disaster Response Team.

The new law will provide liability protection for registered architects under the Iowa Tort Claims Act when volunteering their services to assess property damage in disaster situations. “This legislation opens the door for licensed architects to give back to their communities by using their professional skills and talents. We have over 60 members of the American Institute of Architects in Iowa trained and ready to assist by assessing damage to buildings and other structures in emergency situations,” commented Tom Hurd, AIA, Chair of the American Institute of Architects, Iowa Chapter Disaster Assistance Committee.

Others in this team will include licensed engineers, Department of Public Safety personnel, including Building Code Bureau inspectors and plan reviewers, local building inspectors and other qualified professionals. Members of the Disaster Response Team, after appropriate training, will be registered and added to the roster of the Homeland Security and Emergency Management authorized team. The team will be called the Iowa Building Safety Assessment & Failure Evaluation (B-SAFE) team.
