Seminar Description:

Join us for an overview on how to ensure you and your team are protecting yourselves, your clients, and your projects with the proper contract management techniques and resolution provisions. Learn from Karen Erger of Lockton Companies and Stephen Tyler of Whitfield & Eddy Law on how to navigate the legal issues you face daily. 


Learning Objectives: 

1. Identifying the main distinctions between mediation, arbitration, and litigation and the general process and procedure of mediation, arbitration, and litigation. 

2. Explain several key considerations in deciding between arbitration and litigation. and define certain terms in a dispute resolution clause that warrant negotiation before the contract is executed. 

3. Identify common insurability problems in client drafted agreements and explain why these are not fully insurable and propose alternative language

4. Manage contract risk using risk shifting provisions such as limitation of liability clauses and recognize omissions of important contract terms from client drafted agreements.
